BP to consider a claim of Ministry of Energy on the dispute with Rosneft due to preferences for 60 bln roubles

​The Ministry of Energy of Russia has filed a cassational claim to the Supreme Court for the decision of the district court which made the Ministry issue Rosneft the confirmation of the oil export fact from the deposit of its affiliate Verkhnechonskneftegas which by its characteristics was supposed to be imposed a customs duty in 2012-2013.

A representative of the Ministry of Energy said that in case of satisfaction of Rosneft’s claims at Court, it might intend for the return of about 60 bln roubles of customs duties from the budget.

In its claim the Ministry of Energy asks to the Court to transfer the case to the panel of judges for economic disputes for the reconsideration of decisions of the Courts of Appeal and Cassation in favor of Rosneft. Simultaneously the Ministry of Energy applied to the Supreme Court on the termination of execution of the court proceedings. The claim and application were filed on February 10th.

To receive the customs duty Rosneft needs to submit 2 certificates to the Federal Customs Service: from the Ministry of Energy and Rosnedra with the confirmation of the fact of extraction of preferential oil (by Verkhnechonskneftegas), another one- from the Ministry of Energy with the confirmation of the fact of oil pumping overseas by Rosneft. In early 2015 the agencies refused to issue these confirmations referring to the expiration of the period for their issue.
