Gazprom loses the case on Rosneft’s lawsuit on access to the Sakhalin gas transportation system
The Russia's Supreme Court has dismissed the appeals of Gazprom and Sakhalin Energy to the decision of the District Court, according to which free capacity of the gas pipeline owned by Sakhalin-2 should be provided to Rosneft. According to the published determination of the Supreme Court, there are no reasons for the transfer of the complaints to the Judicial Collegium on Economic Disputes.
The Supreme Court didn’t found violations of the law, justice and ensuring a reasonable balance of private and public interests in the decision of the lower court. Also it didn’t see facts, confirming the violation of any law by the court in the grounds of the complaint, filed by Sakhalin Energy (in which Gazprom owns 50% plus one share) and the gas giant itself.
